What information we collect, how we use it, and our lawful basis
We collect and use personal information for the purposes below. Where we rely on ‘contract’, processing is necessary to enter into or perform a contract with you. Where we rely on ‘legal obligation’, we must process the information to comply with the law. Where we rely on ‘legitimate interests’, the processing is necessary for our business or a third party’s legitimate interests, proportionate, and not overridden by your rights — you can object to this at any time. Where we get personal information from
Directly from you, and from third parties where relevant to our services — including landlords, vendors, buyers, tenants, applicants, guarantors, representatives, contractors, managing agents, other estate agents, surveyors, mortgage brokers, lenders, insurers, credit reference and referencing agencies, identity verification providers, solicitors, conveyancers, regulatory and legal bodies, and publicly available sources.
How long we keep information
We only keep personal information for as long as necessary for the purpose it was collected for, including to provide our services, meet legal and regulatory obligations, resolve disputes and protect our legal rights. Our usual retention periods are:
- Client, landlord, vendor, buyer, tenant, applicant and property records: up to 6 years after the end of the relationship or matter.
- Anti-money laundering, identity verification and due diligence records: 5 years from the end of the relationship or transaction.
- Right to Rent records: for the tenancy and at least 1 year afterwards.
- Accounting, invoicing, payment and tax records: usually 6 years from the end of the relevant financial year.
- Property management, maintenance, safety and complaint records: usually up to 6 years after the matter concludes.
- Marketing records and preferences: until you opt out, or we decide the information is no longer relevant.
- General website enquiries with no business relationship formed: usually up to 2 years.
We may keep information for longer where necessary to comply with the law, resolve disputes, or establish, exercise or defend legal claims. Contact us using the details above for more information on our retention criteria.
Who we share information with
We share personal information only where necessary to provide our services, comply with legal obligations, prevent fraud, manage property transactions and tenancies, or handle queries, complaints and claims. This may include:
- Data processors who support our services — identity, AML and Right to Rent checking providers; tenant referencing and credit checking providers; CRM, lettings and property management software; website, email, cloud storage and IT providers; accounting and e-signature platforms; marketing and analytics providers.
- Landlords, vendors, buyers, tenants, applicants, guarantors, occupiers and their representatives or family members.
- Professional advisers — solicitors, conveyancers, accountants, surveyors, mortgage brokers, lenders, insurers and compliance advisers.
- Contractors and property service providers — maintenance, inventory, EPC, and similar services.
- Deposit protection schemes.
- Property portals and marketing platforms.
- Managing agents, freeholders and block management parties.
- Other estate agents and relocation agents.
- Utility providers and local authorities.
- Regulators and public bodies — including HMRC, the ICO, Trading Standards and the courts.
- Insurers, claims handlers, and debt recovery or enforcement parties, where relevant.
- Anyone else where we are legally required or permitted to share information.
Sharing information outside the UK
Some of our service providers may process personal information outside the UK. For example, Microsoft 365 / Outlook may involve processing by Microsoft or its subprocessors outside the UK, including in the United States. Our other data processors may also use subprocessors based outside the UK.
Where personal information is transferred outside the UK, we make sure appropriate safeguards are in place, such as adequacy regulations, the UK International Data Transfer Agreement, the UK Addendum to the EU Standard Contractual Clauses, or other lawful transfer mechanisms.
